When British kings wanted to dispose of troublesome enemies — real or imagined — they often had them or their colleagues arrested on pretextual charges and then brutally tortured until confessions were extracted. The confessions were then read aloud during so-called trials; and, of course, the defendant was convicted of whatever crime was the subject of the confession.
All this was done in order to satisfy the political, and in many cases the personal, desires of the monarch by creating the impression of due process.
Often the torture occurred in remote places, so remote that there was no government there, and the king and his counselors could argue that the protections of the British traditions of fair play — the British do not have a written Constitution, but rather a set of traditions — was not violated because the torture occurred in a place where the traditions did not apply.
When one of the victims of this practice was an official who had previously engaged in perpetrating it, the House of Commons, many of whose members feared becoming victims of the monarch’s desires, adopted the principle of habeas corpus. That ancient right compelled the jailer of any person anywhere to bring the jailed person before a neutral magistrate and justify the confinement.
Due process has numerous definitions and aspects, but for constitutional purposes it basically means that all charged persons are presumed innocent and entitled to a written notice of the charges, a speedy and fair hearing before a neutral fact finder, a right to appeal; and the entire process imbued with fairness and a profound recognition of personal innocence until guilt is proven beyond a reasonable doubt. Due process also explicitly prohibits the use of torture.
In order to ensure that due process and habeas corpus would trump the whims of government officials — stated differently, to ensure that the British system of torture and confession and conviction did not occur here — James Madison and the Framers crafted protections in the Constitution to which all in government needed to swear allegiance and support.
Fast forward to the United States Naval Base at Guantanamo Bay, Cuba, and you can see the constitutional system turned on its head.
This George W. Bush-crafted American Devil’s Island, which costs $500 million a year to operate, once held 780 prisoners, allegedly there due to their personal involvement in the war on terror against the United States. Not a single one of them has been convicted of 9/11-related crimes, and only one former detainee is currently serving time in an American federal prison.
Nearly all the prisoners were tortured, and most were captured by roving militias and sold to American forces for bounties. Last week, under cover of darkness, the Biden administration released 11 detainees, all of whom had been at Gitmo for 20-plus years and none of whom had been charged with a crime.
The best known of the remaining 15 prisoners is Khalid Sheikh Mohammed, whom the government claims was the mastermind of 9/11. Mohammed was scheduled for trial when the military judge in his case retired. The new judge — the fifth on the case — was confronted with the daunting task of reading 40,000 pages of transcripts and documents concerning the torture of Mohammed by U.S. personnel.
At the same time, a new team of military and civilian prosecutors was assigned to the case and the new prosecutors told their bosses in the Pentagon and the new military judge that unlike their predecessors — who sought to mitigate the 183 torture sessions U.S. personnel administered to Mohammed — they were prepared to acknowledge it and decline to use any evidence obtained from it in the courtroom.
This remarkable turnaround — one that rejected the premises upon which Gitmo came into being — resulted in the prosecutors commencing plea negotiations.
The Bush-inspired premises of Gitmo were that since it is located in Cuba, federal laws don’t apply, the Constitution doesn’t apply and federal judges can’t interfere. In five landmark decisions, the Supreme Court rejected all these premises, and the new team of prosecutors and the new judge recognized as much.
The prosecutors basically said that they cannot ethically defend torture, they will not offer evidence derived from it in the case, and the case is difficult to prove without evidence derived from torture. This is a remarkable lesson to be learned. Instead of cutting holes in the Constitution, follow it. Instead of using torture, use acceptable investigative techniques. Instead of crafting a Devil’s Island, use the systems in place that have basically worked.
The settlement negotiations produced an agreement for a guilty plea that removed the death penalty from the case, required Mohammed to answer truthfully all questions put to him under oath and in public by prosecutors, defense counsel and lawyers for 9/11 victims’ families, and life in prison at Gitmo; not America’s hellhole in Florence, Colorado.
The plea was approved in writing by all, including the retired general in the Pentagon in charge of Gitmo prosecutions — herself a former military appellate judge. When Secretary of Defense Lloyd Austin learned of the plea agreement, he instructed the military prosecutors to move to vacate the agreement they had instigated. The trial judge denied this unique request. Last week, a military court of appeals upheld that denial. Mohammed’s courtroom plea will now take place before President Joe Biden leaves office.
None of this jurisprudential mess would have occurred if Bush had allowed the criminal justice structure to proceed unimpeded. The use of torture, rotating judges and prosecutors, and incarceration for 20 years without charges or trial are all hallmarks of an authoritarian government. If justice consists in convicting the guilty using established norms and fair procedures, Gitmo has been an unjust unhumanitarian disaster. But if justice consists in the king getting whatever he wants, then the Constitution is useless as a protector of freedom.

Jimmy Carter Making Terror Great Again:
Ok Jimmy Carter died. Many will fill volumes writing now that he was a good guy, honest, smart, did some good things as president, and in his post presidency. Despite many of these things being true, to me Carter was an unrepentant anti-Semite who made excuses for Arab aggression and terror against Israel, and empowered the terrorists whose goal to annihilate Israel and the Jewish people are no less part of Carter’s legacy. For that alone and using the pulpit of his presidency in exile to spread these messages, I say good riddance.
As a failed one term president despite some achievements including helping to broker the Camp David peace agreement with Israel and Egypt, Carter’s abysmal policies vis a vis Iran left the US ally Shah Mohammed Reza Pahlavi overthrown by Islamists, himself dying in exile, paving the way for the Islamic Republic regime to take over Iran which it has hijacked for the past 46 years. The Iranian hostage crisis was an example of Carters weakness and underscored by the fact that the hostages were released the day Carter was out of office.
His ineptitude was on full display then and paved the way for the Iranian Islamic regime to become the world’s largest state sponsor of l terror. These are not mere words. Millions of Israelis and Iranians as well as Jews and others are still suffering as a result.
Even Carter suffered. Since 1981 he mourned the murder of his friend Egyptian President Anwar Sadat, gunned down by Iranian inspired Islamic terrorists. Nevertheless, rather than blaming the ayatollahs, Carter missed no opportunity to blame Israel for something.
Carter’s antisemitism was not only unrepentant but arrogant as if only he knew the truth, but his truth was a cocktail of distortions and fantasy, looking at the Middle East through a prism about how he thought things should be rather than how they were.
His book “Palestine Peace Not Apartheid” remains part of Carter’s antisemitic legacy. He deliberately retained and justified his own legitimization of terrorism against Israel despite being called out as such, offering no apology, no correction, no recall: just a playbook about why killing Jews was OK.
Carter wrote, “It is imperative that the general Arab community and all significant Palestinian groups make it clear that they will end the suicide bombings and other acts of terrorism when international laws and the ultimate goals of the ‘Roadmap’ for peace are accepted by Israel.”
Basically: as long as Israel doesn’t do what Carter thinks it should do, terrorism against Israel will continue and is legitimate.
As for propping up the terrorists, Carter not only was among the first to give credibility to Arafat and the PLO, but also Hamas. One has to wonder if, like the terrorists, Carter thought the Hamas massacre of October 7, 2023, was indeed legitimate “resistance,” or if he ever reconsidered his flawed views. We’ll never know, but what we do know is that he never said the later. So, all we have to go by is his justifying and legitimization of terror.
Carter doubled down on his anti-Israel rhetoric and hate as a leading member of “The Elders,” a group of failed world leaders who colluded in multiple ways to continue his anti-Israel diatribe. The Elders were so antisemitic that one could even ask if they were the authors of “The Protocols of the Elders of Zion,” or just devoted followers.
In 2009, Carter visited my neighborhood, Gush Etzion, where he surprised many my stating that in an eventual two state solution (creating a Palestinian Arab state in Judea and Samaria- the “West Bank” and Gaza), he did not envision that Israel would have to return places like this. “I never imagined that Gush Etzion would be transferred to Palestinian hands.”
Maybe he misspoke or was just making friendly chit chat, but the praise he received then for looking at the reality and not stringent black and white policies in which Israel was always to blame was short lived and not repeated. He must have realized that legitimizing Israeli “settlements” in any way complicated his notion that it was still OK for Palestinian Arab terrorists to kill us.
Carter repeatedly blamed he Jews both for voting for Ted Kennedy in his unprecedented primary campaign against a sitting president, and then losing to Ronald Reagan. To him the Jews were disloyal if not all powerful (i.e. Protocols). Unencumbered after living at 1600 Pennsylvania Ave., Carter simply allowed his antisemitic tendencies to take prime time in his Emory University Carter Center.
It never escaped me on my visits to the Carter Center that many of the top donors were anti-Israel Arab leaders, raising the question as to whether Carter’s views were formed by his benefactors, or if the benefactors raced to lay the foundation for a place in which their views were at home with Carter.
As a student at Emory in the 1980s, where his failed presidency found refuge, I had several interactions with Carter, mostly lecturing in different classes. Yes, he was charming, and his soft-spoken demeanor lent one to think he was a good guy.
One day in 1988, I attended an event where he made public remarks following another trip throughout the Middle East where he had no problem cozying up to the original Assad dictatorship and other terror leaders. His public comments throughout the trip were a dizzying litany of anti-Israel comments, throughout the Arab capitals where he was feted, and when he was in Israel. Basically, he blamed Israel for everything wrong and the lack of peace in the Middle East.
During the question and answer, there was time for one question and my hand shot up. It was the week of the anniversary of the Camp David accords, and I thanked him for helping to make that possible to which he responded with his big peanut smile. Then I asked him if, as a representative of Emory University, was it not academically disingenuous to travel the world and blame Israel for lack of peace while not holding the Arabs at least equally accountable.
His peanut smile turned to a scowl, and he began a tirade about how I was wrong, and Israel is to blame. I never had a former president get angry at me and “rip me a new one.”
It felt good not because I upset him, but because I called him out in public for his dishonesty and he had no good answer other than perpetuating his biased rate which was on full display.
Carter had been in hospice care for a very long time and his death was inevitable. From my perspective, long overdue. I ask myself why God gives people like this who have such evil in their hearts so many extra years. My only explanation, or rationalization, is maybe God was giving him a chance to repent, and Jimmy Carter needed that many more years to do so.
I’m not convinced that he did repent, and while it would be inappropriate to throw the baby out with the bathwater and suggest that he never did anything good, which would be dishonest, he was a failed one term president, and he did unambiguously call for and justify the terrorist murder of my people. That disqualifies him from sainthood or many of the other honors and memories that others are sharing and will share in the days to come.
At least in remembering his life, let us remember that he at least indirectly caused tremendous pain and suffering, and death for which building houses for poor people is no redeeming compensation.
